Urgent Actions Upon Death
or What to do when someone dies.
or What to do when someone dies.
Your relative has passed away, you are full of grief and what do you do now? Many of us do not have to deal with this situation but a couple of times in our lifetimes. We tend to get overwhelmed when this situation is dropped upon us for the first time. What do you do first, there are so many things that need to get done quickly. Hopefully your relative has an estate plan set up and things arranged for their demise. I have laid out some of the major things you will need to do in the document below.

Areas Not Handled: After about 15 years of dealing with insolvable domestic situations, I dropped that area. I do not choose to represent the accused in criminal matters. Other areas of the law have now attracted my attention and there are areas best handled by those lawyers dealing with them on a daily basis such as: workers compensation; patent law; income taxation; mediation, labor law, lemon law. Dissolution Reduced unnecessary conflicts in marital cases by providing detailed visitation orders allowing the parties to plan their weeks and the children to know reliably when they were to see dad or mom.
Equity law has been the concentration of my practice for 42 years whether in domestic, probate, probate litigation. That is the area where the judge has more discretion to decided how to fashion an appropriate remedy. In all of these areas I have been pushed to think, “If I were the judge how would I decided?” That has resulted in a high percentage of “wins” because of my taking a more objective view of the case.

DISCLAIMER
Since I am only licensed in California, I can only advise you about California law. Each state, the federal government and Guam and Puerto Rico and the Marianna Islands have (slightly) difference laws, which I do not know. So, any expressions of opinion are relevant only to Calif. law and federal law in the 9th. Dist which contains Calif.
Again, “Free advise is worth what you pay for it”. That’s not just some impudent statement. It’s true because until an attorney looks up the most recent law, and gathers all your information and talks with you, all of which take time and money, he’s really not “on top of the facts” and can’t give you advise on which you should rely.
Now, none of that doesn't mean a quick overview won’t help you or advise like the following won’t help you – it usually will:
-don’t sign anything you don’t understand;
-agree to nothing orally to stop: “but I thought…”; “well he said…”; “he promised…”; “he said, she said, he said”
and on and on. Those things cost money and a piece of paper doesn't.
-a 5 minute call to an attorney is usually far less expensive than a $5,000 retainer when you have been sued!
